STATE FAILS TO FILE COURT PAPERS ON TIME, DELAYS JUSTICE FOR JAMESON TIMBA AND 78 OTHERS

The state has failed to submit court papers on time for an important case involving veteran opposition leader Jameson Timba and 77 others. They were arrested and detained after the state closed its case on Monday. Because of this delay, the court may have to postpone the case again. This means that the accused will stay in detention for a longer time.

Jameson Timba’s son, Ndapuwa Shaun, also made a separate application for discharge. Both applications were made after the state finished presenting its case. The court was supposed to give a ruling today. But now, because the state did not submit its papers on time, the case may take longer.

The defence lawyers sent their application for discharge early on Monday morning. This was right after the state had finished its case. The court then told the state prosecutors, Lance Mutsokoti and Sheila Mupindu, to submit their response by Wednesday at 11 am. If they had done this, the court could have given a ruling today at 2:15 pm. But the state missed this deadline. Instead, they only submitted their response today, much later than expected. Because of this, the defence now has to respond orally in court.

The case is serious. Jameson Timba and 78 others were arrested at his home on Downie Avenue in Avondale, Harare, on June 16. The state says they held an illegal gathering to promote violence. This happened just before the Southern African Development Community (SADC) summit in Harare. Because of the nature of the charges, this case has received a lot of attention.

The delay by the state is making people believe that this is a tactic to keep the accused in detention for a long time. Many people are criticizing the state for this because it goes against justice and fairness. The accused have already spent a long time in jail. Every delay only makes their suffering worse.
